Specific to the Turks and Caicos Islands, we are involved in the highest value disputes in the jurisdiction. This includes insolvency and post-judgment (or award, in respect of arbitration) enforcement. Tim Prudhoe is licensed as an Insolvency Practitioner and the firm regularly advises foreign office holders (trustee-in-bankruptcy, receivers and administrators).

Our disputes client base is widely drawn, both in terms of geographic location and background. In addition to commercial and civil disputes, we are well-known for our work in public law (including judicial review and habeas corpus).

Of course, the value of the dispute does not dictate complexity. We are renowned for tackling controversial issues. Often being adverse to governments. We actively seek “David and Goliath” instructions and regularly change the law by challenging it in Court for clients. Recent examples of this include:

  • Confirming the permissibility of litigation funding both inside and outside of insolvency.
  • Confirming the right to apply directly to the Court of Appeal of the Turks and Caicos Islands Court for the necessary permission to take a criminal appeal to the Judicial Committee of the Privy Council rather than have to seek permission from the Privy Council itself.
  • Obtaining the release via habeas corpus of 21 unlawfully detained migrants.
